1. Convalida Technologies is a Technology, Outsourcing and Product Company. Incepted in 2012, we have been delivering IT solutions in North America & Multi Geo Locations.
2. Through the website, we offer a retail business tool to accelerate the growth of retail as well as hospitality industry including restaurants, hotels etc. Ours is a Point of Sale (POS) system for upcoming and established food chains, hotels and restaurants which aims at providing best and secure sales service (“Software/ Online Services”).

 

2. DATA WE COLLECT FROM YOU OR ABOUT YOU AND OUR SOURCES OF THAT DATA 

The information we use about you falls into two categories: (a) data you give us; and (b) data we collect from or are provided by third parties.

Technical information, including the type of device (and its unique device identifier) you use to access the website, the Internet protocol (IP) address used to connect your device to the Internet, your unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, your device and component serial numbers, your login information, browser type and version, time zone setting, browser plug in types and versions, operating systems, mobile network information and platform and details of any referring website or application; and
      2. information about your visit to the website including full Uniform Resource Locators (URL), location data, click- stream to, through and from the Online Services (including date and time), pages you viewed, page response time, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

      1. We may be given information about you from third parties, such as, the search engines or social media platforms.  We may also collect information that is publicly available. For example, we may collect information about you when you interact with us through social media.

1. 1. To generate your login username and password in order to create your account with us - your full name, email address, phone number, restaurant name, restaurant location, and restaurant contact details;
   2. To process any payments you make - Your name, bank details, credit card and/or debit card details;
   3. To provide the online services that you opt for – this information may differ depending on the product choices you make, for instance, if you opt to simply add a website ordering widget -  your full name, email address, phone number, restaurant name, restaurant location, restaurant contact details, trademarks, trade names used by the Restaurant’s name or any other intellectual property rights such as product graphics or other graphic designs to be inserted in the widget created by us for you; if you opt to receive premium services such as Online / Credit Card Payment Service – in addition to above, bank account details; Sales Optimized Website, Advanced Promo Marketing, Run a Promo or Coupon Deal.
   4. To process any payments you make using a gift card - Your name and gift card details;
   5. To manage our relationship with you, including a) deal with any enquiries, correspondence, concerns or complaints you have raised; b) notifying you about changes to the terms of service or this privacy policy; or c) asking you to provide us with your comments or feedback - Your name, information about the issue raised, phone number and email address (if applicable).
   6. To send you our newsletter or update and to keep in touch with you - Your name and email address;
   7. To tell you about our restaurants, services, products, offers, promotions or special events that we believe may interest you - Your name and email address;

   9. To enable you to partake in a prize draw, competition or survey - Your name, mobile no. and email address;
   10. To provide personalized online content to you (via the Online Services, social media platforms and our online partners) - The technical information mentioned above, your name and email address;
   11. To enable us to keep the Online Services safe and secure - Your contact details and the technical information mentioned above;
   12. To compile reports (which do not personally identify you) about the use of the Online Services - The technical information mentioned above;
   13. To ensure that the content on the [Online Services / Website] is presented in the most effective manner for you and for your device - The technical information mentioned above;

We do not sell your personal data to third parties and only share your information as described in this privacy policy.  

4. PERSONAL DATA OF CHILDREN
   1. We do not knowingly collect information from children under the age of 18 (or the legal age of majority if different in your jurisdiction). 5. DISCLOSURE OF YOUR PERSONAL DATA
   1. We will share your personal data with the customers accessing the website created by us for you for selling, marketing and receiving online food orders.
   2. We may share your personal data with selected third parties in accordance with this privacy policy, as follows:
      1. with Facebook (if you use your account with them to sign up / in with us), if applicable.
      2. service providers (for example CRM services), business partners, suppliers and sub-contractors for the performance of any contract we enter into with you, but also when sending out marketing communications.
      3. professional advisers acting as processors or joint controllers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.
      4. with vendors who provide services to us, such as, providing data processing and other information technology services, managing promotions, carrying out research and analysis, and personalizing individual customer experiences.  We do not allow these vendors to use this information or to share it for any purpose other than to provide services on our behalf. 
      5. with analytics and search engine providers that assist us in the improvement and optimization of the Website and the Online Services.
      6. with government or other law enforcement agencies, in connection with the investigation of unlawful activities or for other legal reasons (this may include your location information).
      7. with third parties, who acquire us or substantially all of our assets, in which case your personal data (including any sensitive personal data) will be one of the transferred assets (however, we will let you know before this happens).
      8. with public in general for our advertisement and marketing purposes, if you have used our software and online services as the same would become a part of our credentials and achievements. This would include data such as your name, website URL, trademark or tradename in our “credentials/ clients” section.

The personal data that we collect from you will be processed and stored at, destinations within the USA. In certain extraneous circumstances, we may transfer, process or store your data in destinations outside the USA. This includes any country where our external service providers may be based or hosting your personal data on our behalf.  
   2. If we transfer your personal data out of the USA, we ensure that a similar degree of protection is afforded to it.

   5. If  you use our Software/ Online Services, we retain our right to  use your name/ the website URL created by us, your trade name, your customer lead generation through our services etc., as credentials for marketing and advertisement purposes for indefinite period of time.

 

9. YOUR LEGAL RIGHTS 

You have the following rights with regard to your personal data:

You have the right to have personal data rectified. You can rectify personal data if it is inaccurate or incomplete. You must rectify any inaccurate personal data that relates to you without undue delay, and in any event within one month.
